PREAMBLE
Any purchase made on the website www.notesdebasdepaje.com (hereinafter the “ Site ”) is subject to acceptance of these general conditions of sale (hereinafter “ CGV ”) which exclusively govern all of the contractual relations between:

Any legal or natural person, of legal age or holder of parental authorization and possessing full legal capacity to contract, wishing to purchase the products offered for sale by NOTES DE BAS DE PAJE on the Site (hereinafter the “ Products ”) ) and acting for purposes which do not fall within the scope of its commercial, industrial, artisanal, liberal or agricultural activity (hereinafter the “ Client ”).
The General Terms and Conditions define the rights and obligations of the Parties in the context of the sale of Products on the Site.
This preamble, the Legal Notices and the Privacy Policy of NOTES DE BAS DE PAJE form an integral part of the General Terms and Conditions.
The Customer declares to have obtained from NOTES DE BAS DE PAJE, prior to any order for Products, all the information on them as well as the terms of their delivery. He declares that he is solely responsible for the choice of Products as well as their suitability to his needs.
NOTES DE BAS DE PAJE is free to modify, at any time and without notice, these General Terms and Conditions, in particular to take into account any legal, jurisprudential and/or technical developments. NOTES DE BAS DE PAJE will inform the Customer by any means, who must accept the new General Terms and Conditions.
Each order for Products will be deemed to have been subscribed under the terms of the General Terms and Conditions in force on the day of said order.
NOTES DE BAS DE PAJE reserves the right to refuse any order for Products in the event of non-compliance with the General Terms and Conditions by the Customer.
1) DEFINITIONS
Customer: refers to any adult natural or legal person who browses the Site, becomes aware of the Products and/or Orders Products on the Site.
Order: designates the process consisting of the Customer selecting on the Site the Products he wishes to purchase and paying the amount to be paid to NOTES DE BAS DE PAJE.
Contract : refers to these General Terms and Conditions and any special conditions applicable to certain promotional operations.
Internet: refers to different networks of servers located in various locations around the world, linked together using communication networks, and communicating using a specific protocol known as TCP/IP.
Parties: jointly refers to NOTES DE BAS DE PAJE and the Client.

2) PRODUCTS
The Products sold by NOTES DE BAS DE PAJE comply with current French regulations, particularly relating to cosmetic products.
As such, the container and packaging of the Products bear in indelible characters, easily visible and readable, all the information required by Regulation (EC) No. 1223/2009 relating to cosmetic products.
The Products are sold while stocks last. Despite all the precautions taken, it is possible that a Product ordered is no longer available. In such a case, NOTES DE BAS DE PAJE undertakes to inform the Customer as soon as possible and, where applicable, to reimburse the entire amount paid using the same means of payment as that previously used by the Customer. Customer.
If stocks are exhausted, NOTES DE BAS DE PAJE will endeavor to indicate this on the Site and make it impossible to Order the Product concerned. NOTES DE BAS DE PAJE will offer, in the event that a Product is no longer available, to the Customer to provide their email address so that NOTES DE BAS DE PAJE can inform them as soon as possible of the availability of the Product.
3) ORDER
After having read the Products offered by NOTES DE BAS DE PAJE on the Site and, where applicable, having contacted NOTES DE BAS DE PAJE customer service, the Customer is invited to add one or more Products to their virtual basket .
A summary of his Order is then offered to him (product reference, quantities, unit price, price including tax, etc.) so that he can, if necessary, modify his Order before finalizing it. On this occasion, NOTES DE BAS DE PAJE informs the Customer of the authorized means of payment, the delivery methods, the option he has to return the Products ordered within fourteen (14) days under the conditions of the article 12 of the General Terms and Conditions.
Once the Order is finalized, the Customer is invited to:

The Order is only validated by NOTES DE BAS DE PAJE after
(i) acceptance of the General Terms and Conditions by the Customer,

NOTES DE BAS DE PAJE undertakes to send the Customer, by email, an Order confirmation including in particular:
- A summary of the Products ordered and their references;
- The price of the products ;
- The quantity of the Products;
- The date of the Order;
- Product delivery costs;
- The payment method chosen by the Customer;
- The statement that the Customer benefits from a withdrawal period and the applicable deadline.
NOTES DE BAS DE PAJE will also send the Customer an invoice by email to the address provided during the Order. The Customer is advised to save or print his invoice and keep it.
The Client must check the content of the communication as quickly as possible and immediately notify NOTES DE BAS DE PAJE of any errors or omissions.
The absence of a response to confirmation of receipt of the Order constitutes express acceptance of it and its terms by the Customer.
The Company reserves the right to refuse any Order in the event:
- Existing or past dispute with the Client;
- Total or partial non-payment of a previous Order by the Customer;
- Refusal of authorization for payment by bank card from banking organizations;
- Abnormally high quantity of Products for a consumer.
Any Order implies an obligation of payment by the Customer.
NOTES DE BAS DE PAJE undertakes to honor validated Orders, within the limits of available stocks.
4) PRICE
The price of the Products is mentioned in euros, all French taxes included (French VAT and other applicable taxes), excluding delivery costs which are notified to the Customer at the time they place the Order.
In the event of a change in the VAT rate, the price will be automatically changed without further notice on the due date of the new rate.
NOTES DE BAS DE PAJE reserves the right to modify its prices at any time. The Products will be invoiced on the basis of the prices in effect at the time of validation of the Order.
In the event that an abnormally low price is indicated due to a technical or human error, NOTES DE BAS DE PAJE reserves the right to ask the Customer to supplement the price already paid or to allow him to cancel your Order by reimbursing the entire amount already paid.
5) PROMOTIONS AND DISCOUNTS
NOTES DE BAS DE PAJE may organize various promotional operations, particularly in the form of announcements of price reductions in the context of private sales or NOTES DE BAS DE PAJE days. Price reductions are established in relation to reference prices which generally correspond to the prices offered to current customers outside the reduction period considered.
Unless otherwise stated or absent,
Any promotional codes offered by NOTES DE BAS DE PAJE, particularly when purchasing a discovery box, only apply to non-discounted base prices. Promotional codes cannot be combined with each other or with vouchers. Promotional codes can be used once (1) per Customer and valid for a period of one (1) month unless otherwise instructed by NOTES DE BAS DE PAJE. Products purchased with these codes cannot be exchanged or refunded.
6) PAYMENT
Payment for Orders is made in cash on the day of the Order by credit card (Visa, Mastercard, Carte Bleue, American Express).
NOTES DE BAS DE PAJE uses the services of Stripe which ensures the secure transmission, using the SSL protocol, of bank card numbers. Exceptionally, NOTES DE BAS DE PAJE reserves the right to suspend an Order and ask its Customers for any additional useful information in order to guarantee the absence of fraudulent use of a means of payment.
Payments by Paypal are accepted on the Site and are then made via the PAYPAL companies, and their own general conditions of sale and use of their services.
Choosing this payment method constitutes acceptance of the general conditions of sale and use of PAYPAL companies ( accessible here ).
NOTES DE BAS DE PAJE cannot be held responsible in place of PAYPAL.
The online provision of the bank card number or other banking information and the validation of the Order and its payment will constitute proof of the entirety of said Order, and will constitute payment of the sums incurred by the Order.
However, in the event of fraudulent use of their bank card or banking information, the Customer is invited, as soon as this use is noticed, to contact NOTES DE BAS DE PAJE customer service by email at the address email help@notesdebasdepaje.com.
It is expressly agreed that, unless there is a manifest error on the part of NOTES DE BAS DE PAJE, the data stored in the computer systems of NOTES DE BAS DE PAJE and Stripe, under reasonable security conditions, has probative force regarding the Orders placed. by the customer. Data on computer or electronic media constitute valid proof and as such, are admissible under the same conditions and with the same probative force as any document that would be established, received or kept in writing.
The archiving of purchase orders and invoices is carried out on a reliable and durable medium so as to correspond to a faithful and durable copy.
7) DELIVERY
a) Delivery costs
Delivery costs are specified on the Site and indicated in euros including tax when placing the Order. They are the responsibility of the Customer who must accept them when validating the Order.
These costs may vary depending on the weight, volume, nature of the Order, as well as the carrier chosen, the delivery method and the delivery location.
Unless otherwise stated on the Site, delivery costs are free for orders placed in France.
b) Delivery methods:
When placing an Order, Customers are invited to choose from the possible delivery methods offered by NOTES DE BAS DE PAJE.
Unless otherwise stated on the Site, deliveries will be made by “Colissimo” to the address provided by the Customer when taking the Order or to a collection point of the Customer's choice for deliveries in Metropolitan France, within the time limits indicated. during the order.
Any shipment of an Order will be notified by NOTES DE BAS DE PAJE or by the carrier concerned to the Customer by sending an e-mail allowing, where applicable, the delivery to be followed. Delivery will be deemed to have been made at the moment when the Customer or a third party designated by him, and other than the carrier offered by NOTES DE BAS DE PAJE, takes physical possession of the Product.
c) Delivery locations:
Deliveries can be made to mainland France, Corsica, Monaco and internationally (unless otherwise specified on the Site or on any other support in the case of unserved geographical areas).
Deliveries are made either to the address provided by the Customer or to the collection point selected by the Customer for deliveries in Metropolitan France, provided that this option is offered to the Customer when placing the Order.
d) Delivery times :
The expected delivery date of the Products is indicated during the Product Order process and before validation of said Order. Delivery times are also reminded in the Order confirmation email sent to the Customer.
Delivery times include the preparation and shipping of the Order, as well as the delivery time of the Products to the point of delivery, to the Customer's postal address or to a relay point.
Average delivery times excluding customs processing are between:
- forty-eight (48) and seventy-two (72) hours for mainland France, Corsica and Monaco;
- eleven (11) and thirty-one (31) days for France Overseas;
- three (3) to eight (8) days outside these territories.
In the absence of an indication on the Site of a delivery time for the Products, NOTES DE BAS DE PAJE undertakes to deliver them within a maximum period of thirty (30) days from the Order validation email sent to Customer by NOTES DE BAS DE PAJE.
However, NOTES DE BAS DE PAJE uses external service providers for the delivery of Products, NOTES DE BAS DE PAJE is dependent on these third party service providers. In the event of a delivery delay attributable to service providers, NOTES DE BAS DE PAJE cannot be held responsible for additional delays or the consequences that may result.
NOTES DE BAS DE PAJE informs the Customer that the delivery of several Products from the same Order may be fragmented. The Customer will be informed by email.
In the event of a delivery delay of more than thirty (30) days, the Customer may cancel his Order, by registered letter with acknowledgment of receipt or by writing on another durable medium addressed to the customer service of NOTES DE BAS DE PAJE , if, after having ordered NOTES DE BAS DE PAJE, according to the same terms, to make the delivery or provide the service within a reasonable additional period, NOTES DE BAS DE PAJE has not complied within this period.
In such a case, the Order will be considered canceled upon receipt by NOTES DE BAS DE PAJE of the letter or writing informing it of this cancellation, unless NOTES DE BAS DE PAJE has complied in the meantime. .
In the event of cancellation of an Order in the aforementioned forms, NOTES DE BAS DE PAJE will reimburse the Customer for all sums paid, no later than fourteen (14) days following the date of cancellation.
8) RECEPTION
Delivery is made by placing the Order in the Customer's mailbox, this being proof of good receipt of the Products, unless the Customer has chosen the option of delivery against signature in which case delivery will be made against signature.
The transfer of risks and liability relating to the Products occurs upon receipt of the Products by the Customer.
From this date, the Customer will be solely responsible for them, as well as for their use and any consequences that may result therefrom.
Consequently, the Customer undertakes to check, at the time of delivery, that the Order delivered is complete, compliant and has not been damaged. Any anomaly/reservation identified at the time of delivery must be reported completely and precisely by the Customer on the receipt given by the carrier at the time the Products are made available and/or confirmed by registered letter to the carrier within ten (10) days following receipt of delivery.
Any Order received by the Customer will be considered to be compliant, complete and in perfect condition at the time of delivery in the absence of such a report.
Any apparent anomaly concerning an Order (number of units, condition of packaging, etc.) must be precisely indicated by the Customer on the carrier's delivery note, in the presence of the latter.
The Customer must immediately inform NOTES DE BAS DE PAJE by providing any useful evidence (photograph, description of the anomaly, etc.). An apparent anomaly means any anomaly which should normally be detected by a normally attentive and informed consumer. Failing this, the Products will be deemed to have been delivered free of any apparent anomaly.
It is therefore up to the Customer to preserve his rights vis-à-vis the carrier.
9) RESERVATION OF OWNERSHIP
NOTES DE BAS DE PAJE retains ownership of the Product sold until full and effective payment of the price by the Customer.
Until full payment of the price, the Customer will therefore refrain from granting a pledge or pledge on the Products subject to retention of title or from using them as a guarantee and must individualize the Product coming from NOTES DE BAS DE PAJE.
These conditions do not prevent the transfer to the Customer, upon delivery of the Product, under the conditions of article 5 of these General Terms and Conditions, of the risks of loss and deterioration of the Products subject to retention of title, as well as the liability of any damage or harm they may cause. The Customer is therefore invited to take out insurance guaranteeing the risks arising from the Product from its delivery.
10) GUARANTEES
All Products, tangible movable goods, sold remotely benefit from the legal guarantee of conformity and the legal guarantee against hidden defects under the conditions of articles L.217-4 et seq. of the Consumer Code and 1641 of the Civil Code as well as , where applicable, the manufacturer's contractual warranty integrated into the purchase price of the Product.
a) Legal guarantee of conformity
The Products are subject to the legal guarantee of conformity:
“ The seller is required to deliver goods in conformity with the contract and is liable for any lack of conformity existing at the time of delivery. The Customer can choose between repairing or replacing the Product, subject to the cost conditions provided for by article L.217-9 of the Consumer Code;
b) Guarantee against hidden defects
The Products offered on the Site are subject to the guarantee against hidden defects:
“ The seller is bound by the guarantee for hidden defects in the thing sold which make it unfit for the use for which it is intended, or which reduce this use to such an extent that the buyer would not have acquired it , or would not have purchased it. would have given only a lower price if he had known about them .
Action resulting from hidden defects must be brought within two (2) years from the discovery of the defect.
The Customer may decide to implement the guarantee against hidden defects in the item sold by choosing between canceling the sale or reducing the sale price.
c) Conditions for exercising guarantees:
In the event of non-conformity or hidden defect of the Product, the Customer is required to send his complaint to NOTES DE BAS DE PAJE.
In the event of returning a Product, the Customer is invited to follow the procedure described in article 12 of the General Terms and Conditions.
The exercise of these guarantees takes place without any cost for the Customer, provided however that the latter is justified in requesting the benefit of these guarantees.
The Customer is informed that NOTES DE BAS DE PAJE regularly carries out tests relating to the conformity of the products sold and the proof of conformity of the batches analyzed, which are kept within the premises of NOTES DE BAS DE PAJE, may, if necessary , be opposed to Customers.
In the event that NOTES DE BAS DE PAJE notes abusive or bad faith use of the legal guarantee of conformity or hidden defects (abnormally high frequency of use, returned Product not corresponding to the Product purchased, Product returned late or in a clearly depreciated state (unsealed or damaged), non-conformity of a Product which clearly results from inappropriate use by the Customer, etc.), NOTES DE BAS DE PAJE reserves the right to put the Customer on notice to present, in a period of eight (8) days, its observations on the alleged grievance.
In the absence of a response or in the absence of a satisfactory response, NOTES DE BAS DE PAJE reserves the right to invoice the Client for compensation proportional to the management costs made necessary to process an abusive or bad faith request.
11) WITHDRAWAL
Customers are informed that they benefit from the right to withdraw without giving reason within a period which expires fourteen (14) days after the day on which they themselves, or a third party other than the carrier and designated by them, takes physical possession some products.
In the case of an Order for several Products delivered separately or for a Product delivered in several batches or pieces, this period expires on the day you take possession of the last Product / batch / piece. The day on which the Order is concluded or the day of receipt of the Product is not counted in this period. If this period expires on a Saturday, Sunday or public or non-working holiday, it is extended until the first following working day.

To exercise their right of withdrawal, Customers are invited, before the expiry of the aforementioned period, to notify their decision to withdraw to the customer service of NOTES DE BAS DE PAJE by means of an unambiguous declaration ( e.g.: letter sent by post, email, etc. ), using, where applicable, the form provided at the end of these General Terms and Conditions.
Customers can also use the procedure provided on the Site by connecting to their account under the “ returns ” tab (an acknowledgment of receipt will be sent without delay).
After having exercised their right of withdrawal, the Customer is invited to return the Product concerned to the following address: 8 rue du Château Landon 75010 PARIS without undue delay and no later than fourteen (14) days after having communicated to NOTES DE BAS DE PAJE his decision of withdrawal. This deadline is deemed to be respected if the goods are returned before the expiration of this period. The costs and risks linked to the return are the sole responsibility of the Customer.
In the event of withdrawal, NOTES DE BAS DE PAJE will reimburse all payments received, including delivery costs ( with the exception of additional costs arising from the fact that the Customer has chosen a delivery method other than the less expensive method offered by NOTES DE BAS DE PAJE ) without undue delay and no later than fourteen (14) days from the day on which NOTES DE BAS DE PAJE was informed of the decision to withdraw ( reimbursement may be deferred until NOTES DE BAS DE PAJE has received the goods concerned or until the Customer has provided proof of shipment of the goods, the date chosen being that of the first of these events ). The same means of payment as that used during the Order will be used, unless the Customer expressly agrees to a different means.
The responsibility of the Customer who exercises his right of withdrawal may be incurred with regard to the depreciation of the good concerned resulting from manipulations other than those necessary to establish the nature, characteristics and proper functioning of this good.
Finally, on an exceptional basis, provided that it is justified and informed in advance, NOTES DE BAS DE PAJE reserves the right to invoice the Client for compensation proportional to the management costs made necessary to deal with the abusive exercise or bad faith right of withdrawal ( returned product not corresponding to the product purchased, etc. ) after having given him formal notice to present, within eight (8) days, his observations on the grievance with which he is accused and in the hypothesis where the latter would not provide a satisfactory answer.
12) RETURN
The returned Products must be accompanied by all their accessories, the purchase invoice, the return slip issued by NOTES DE BAS DE PAJE on the Site or by email, perfectly protected and sent by postal mail, at the risks and perils of the Customer, at the following address: 8 rue du Château Landon 75010 PARIS.
The Products must be returned at the Customer's expense in their original packaging and in perfect condition for resale (not damaged, unsealed, damaged, used or soiled).
Depending on the evidence provided by the Customer to NOTES DE BAS DE PAJE as part of the exercise of one of the applicable guarantees, therefore excluding the right of withdrawal, NOTES DE BAS DE PAJE is likely to issue a prepaid voucher which will allow the Customer to return the Product without having to bear the costs.
13) INTELLECTUAL PROPERTY
NOTES DE BAS DE PAJE is the exclusive owner of the intellectual property rights on the Products offered on the Site or in physical stores, on their containers and packaging, on the brands, service marks, shape marks, designs and models and rights of the author associated with the Products, on the Site and all its elements, in particular on the visual and graphic identity, on its design, on its ergonomics, its functionalities, on the software, texts, animated or still images, sounds, know-how , designs, graphics and on the names, acronyms, logos, or other signs which could be used, produced or used by NOTES DE BAS DE PAJE.

14) PERSONAL DATA
NOTES DE BAS DE PAJE collects personal data depending on the services that the Customer uses, via technologies such as cookies or trackers, and in particular when taking an Order.
Consequently NOTES DE BAS DE PAJE invites the Client to read, on the Site, the section relating to the Confidentiality Policy and processing of personal data as well as the use and storage of cookies and trackers. This section is an integral part of these General Terms and Conditions.

15) FORCE MAJEURE
The liability of either Party cannot be sought if the execution of the Contract is delayed or prevented due to a case of force majeure or a fortuitous event, due to the other party or of a third party or external causes such as social conflicts, intervention by civil or military authorities, natural disasters, fires, water damage, interruption of the telecommunications network or the electricity network.
16) RESPONSIBILITY
NOTES DE BAS DE PAJE only supports an obligation of means.
Consequently, NOTES DE BAS DE PAJE cannot be held liable for any indirect damage caused by its actions or the Products or damage of any nature resulting from the unavailability of the Site.
Likewise, NOTES DE BAS DE PAJE cannot be held responsible for any inconveniences or damages inherent in the use of the Internet network, in particular a break in service, an external intrusion or the presence of computer viruses.
NOTES DE BAS DE PAJE cannot be held responsible for a presentation of the Products which does not allow the Customer to view them in a complete and completely faithful manner (e.g. color appearing on the screen showing differences with the color of the Products etc. ...).
NOTES DE BAS DE PAJE undertakes to describe with the greatest accuracy or present a photograph of the Products sold on its Site, it being understood that the photographs present on the Site are not contractual.
The Customer is invited to inform NOTES DE BAS DE PAJE of any error that he may notice in the description or photograph of a Product.
The Customer acknowledges and accepts that the prices of the Products are likely to vary between the Site and the physical points of sale, and that in no case can this price difference be the basis for a request for reimbursement, either total or partial, of the Products purchased either on the Site, or at a physical point of sale.

17) GENERAL PROVISIONS
Completeness of the General Terms and Conditions
The Parties acknowledge that these General Terms and Conditions constitute the entire agreement concluded between them and replace any prior offer, provision or agreement, written or oral.
The titles of the Articles of these General Terms and Conditions have been inserted for the convenience of the Customer and in no way with the aim of restricting or modifying any of the terms or stipulations herein.
Modification of the T&Cs
No subsequent document, no modification of the General Conditions of Sale, whatever its form, will produce any effect between the Parties without taking the form of an amendment duly dated and signed by them.
Nullity
If any of the stipulations of the T&Cs prove to be void with regard to a rule of law in force or a judicial decision that has become final, it would then be deemed unwritten, without however resulting in the nullity of the T&Cs or altering the validity of the T&Cs. validity of its other provisions.
Domiciliation
The Parties elect domicile at the addresses indicated on the order form for the Customer and at the address appearing on the Site for NOTES DE BAS DE PAJE.
Applicable law and disputes
The General Terms and Conditions are concluded in French and are entirely governed by French law.
In the event of a dispute relating to an Order, the Customer must first contact NOTES DE BAS DE PAJE, in order to find an amicable solution, by email to the address contact@notesdebasdepaje.com .
Referral to the mediator can only take place after the Client has taken prior written steps with NOTES DE BAS DE PAJE.
The Parties have the right to resort to conventional mediation or any alternative method of conflict resolution in the event of a dispute. The mediator's referral is the responsibility of NOTES DE BAS DE PAJE. The Parties are free to refuse the solution proposed by the mediator. The mediator of NOTES DE BAS DE PAJE is the CM2C ( https://www.cm2c.net/ ).
In addition, the European Commission has set up an Online Dispute Resolution platform, facilitating the independent out-of-court settlement of online disputes between consumers and professionals in the European Union. This platform is accessible at the following link: https://webgate.ec.europa.eu/odr/ .
It is expressly recalled that requests for amicable settlement do not suspend the time limits for bringing legal action.
The competent Court in the event of a dispute will be that of the defendant's place of residence, or, at the defendant's choice, the place of actual delivery of the Product.
